YLD is structured as a directory of Creators, allowing Visitors to browse Creators’ Content and enjoy free or paid content and services. The catalog of services available on the Platform (hereinafter collectively referred to as the “Services”) includes: Live Dates (Video Calls) A Live Date is a private and secure video call with a Creator. Live Dates can be conducted from various devices. You must be a registered user to book a Live Date. Paid Content Some content published by Creators is accessible through payment of an amount defined by the Creator. Premium Messaging Premium Messaging allows Users to contact Creators directly via text messages. You can access chat from the Creator's profile service menu or the main menu. Messages may be free or paid depending on the Creator. Tips Through tipping, you can support your favourite Creator. You can tip a Creator from their profile service menu or the tipping menu during a Live Date. Access to Live Dates is facilitated through virtual rooms (“Room”). Each Room has a unique link (“Room-Link”), which the User can find in their booking schedule upon reservation. The link will also be sent to their registered email address. Content Monitoring & Moderation Policy We actively monitor the content uploaded to YLD to ensure compliance with these Terms & Conditions. Content is reviewed before publication, and any violation of policies, including illegal, non-consensual, or otherwise restricted material, will result in immediate removal and potential suspension or termination of the associated account. We employ 24/7 monitoring to ensure adherence to these standards. 3. REGISTRATION CONDITIONS 3.1. Account Registration Requirements To access the Services, Visitors must first register an account on the Platform (hereinafter, the "Account") as account holders (hereinafter, "Users"). Registration entails acceptance of the Platform’s Terms of Use for Creators or the Terms of Use for Fans, depending on whether the Visitor registers as a Creator or Fan. To register on the Platform, a valid email address, username, and password will be requested. Regarding the collection of personal data by OASIS, the provisions of Section 9 of these Terms of Use shall apply. To register as a User: - The Visitor guarantees they are at least 18 years old - If the laws of their residence require a higher legal age to be bound by a contract like the YLD Terms of Use, they must be of legal age according to the laws of their country or state/province - If OASIS requires any additional information or verification records, they must provide it as soon as possible - The laws of their country or state must permit the use of the Services as a User or Creator User Responsibilities Include: - Providing truthful and accurate information - Maintaining account security - Reporting unauthorised account use immediately Complaints & Content Removal Policy - If illegal or non-consensual content is found, it will be removed within 24 hours - General complaints will be addressed within 7 days - If an investigation is pending, the content will be made unavailable until resolved Visitors should not register if they do not meet these requirements. Passwords are personal and non-transferable. If a User becomes aware of or suspects the loss, theft, or misuse of their password by third parties, they must notify OASIS as soon as possible. Each User is responsible for any expenses or damages incurred through the unauthorised use of their password due to negligence or loss. 3.2. User Guarantees and Obligations The User: - Guarantees that all information provided to OASIS is truthful, accurate, and complete. - Agrees to update any information provided to OASIS immediately if it changes. - Agrees to maintain the confidentiality and security of their account and login details. - Is responsible for all activity conducted through their account, even if used by another person contrary to these Terms of Use. - Must immediately notify OASIS in case of suspected unauthorised use of their account. - Agrees to log out at the end of each session and take extra care when accessing their Account from public or shared devices. - Violation of these obligations may result in OASIS terminating the relationship with the User and closing their account. 3.3. Account Deletion A User may delete their Account through the "Account" section at [www.yourlivedate.com/account]. OASIS informs that: - A Fan's Account will be deleted within a reasonable period after the User's request. Credits acquired cannot be refunded, so it is recommended to use all credits before canceling the account. - A Creator's Account will be deleted after all scheduled services have been delivered or canceled per the service rules. Credit withdrawal is not possible after canceling the account, so it is recommended to withdraw all credits before account closure. - Once deleted, the Account and uploaded Content will no longer be accessible. OASIS will block the data in accordance with its Privacy Policy. - The User will receive an email confirmation of their Account deletion. 4. CONDITIONS OF USE FOR CONTENT AND SERVICES 4.1. Visitor Obligations Visitors must use the Services diligently, legally, appropriately, and lawfully. Visitors shall be liable for damages of any nature that OASIS may suffer directly or indirectly due to non-compliance with these Terms of Use. 5. EXCLUSION OF WARRANTIES AND LIABILITY 5.1. OASIS Liability Limitations OASIS shall not be responsible for: - Service interruptions, delays, errors, or malfunctions due to external causes, force majeure, or third-party actions; - The use Visitors make of the Content, passwords, or any material that may violate intellectual or industrial property rights or any other rights of third parties; - Security issues resulting from outdated browsers, viruses, or incorrect browser configurations; - The presence of viruses or harmful elements in the Content that may alter computer systems. User Responsibility in Service Use OASIS acts as a technology intermediary and does not modify or control Content uploaded by Users. Users are solely responsible for their Live Dates and Content. Users are responsible for having the technical means to use the Platform optimally, including a device with an internet connection and a webcam for Live Dates. 6. INTELLECTUAL PROPERTY & THIRD-PARTY LINKS All content on YLD is the property of OASIS or its respective owners. Users grant OASIS a non-exclusive, transferable, sub-licensable license to use their uploaded content for operational and promotional purposes. Third-Party Links (Outbound Links) YLD may contain links to external websites (“Linked Sites”). While OASIS is not responsible for the content, legality, quality, availability, accuracy, or usefulness of Linked Sites, we will remove any links found to be in violation of our policies. If a Visitor believes a Linked Site contains unlawful content, they may report it to OASIS at report@yourlivedate.com. OASIS is not obligated to remove reported links but may do so at its discretion. PAYMENT, BILLING, & REFUND POLICY Users must comply with the following payment terms: - The length of any trial, promotional period, or introductory offer will be disclosed before purchase. - Transaction amounts and subsequent charges will be clearly stated. - Users will be informed about how to cancel recurring payments before being charged. - Refunds are not available for unused credits. - Refund requests must be submitted within 7 days of the transaction date for evaluation. 9.
